Step-by-Step Guide

How to calculate lawyer's fees step by step: 1. Determine the value in dispute (Gegenstandswert/Streitwert): For monetary claims: the amount claimed. For dismissal: 3 gross monthly salaries (employment law). For tenancy disputes: 12 monthly rents. For traffic accidents: the amount of damages. 2. Define the type of activity: Out-of-court advice: initial consultation max. EUR 190 net (consumers). Out-of-court representation: business fee 0.5-2.5 times (median fee 1.3). Court representation: procedural fee (1.3) + hearing fee (1.2). Settlement: settlement fee (1.0-1.5). 3. Read off the fee from the RVG table: At a value in dispute of EUR 5,000: one full fee = EUR 303. At EUR 10,000: EUR 486. At EUR 25,000: EUR 788. 4. Multiply the fees: Procedural fee: 1.3 x table fee. Hearing fee: 1.2 x table fee. 5. Add the lump-sum expenses (EUR 20) and 19 % VAT. Example: Civil lawsuit, value in dispute EUR 10,000. Table fee: EUR 486. Procedural fee (1.3): EUR 631.80. Hearing fee (1.2): EUR 583.20. Lump-sum expenses: EUR 20. Subtotal: EUR 1,235. VAT (19 %): EUR 234.65. Total lawyer's fees: EUR 1,469.65. In the event of a settlement, a settlement fee (1.0 = EUR 486 + VAT) is added. If you lose, you also pay the opposing lawyer's fees.
